These Terms of Service (“Terms”) govern your use of the BloomEDU mobile application (“App”), provided by Skylark Creations LLC (“we” or “us”). By downloading or using BloomEDU, you agree to abide by these Terms. Please read them carefully. If you do not agree, you must discontinue use of the App.
You must be at least 13 years old to use BloomEDU. By using the app (with or without an account), you affirm that you are 13 or older (or the minimum age of digital consent in your country) and capable of understanding and agreeing to these Terms. The App is intended for general audiences of wildflower enthusiasts and is not directed at children. If you are under 18, you should use the app with the consent of a parent or guardian.
Creating an account is optional. You can use core features like browsing plants, taking quizzes (with daily limits for free users), and purchasing premium subscriptions without registering. However, some features require an account:
If you choose to create an account, you agree to provide truthful, current, and complete information during signup. You are responsible for maintaining the confidentiality of your login credentials. Do not share your password with others. We use secure hashing for stored passwords, but you are responsible for any activity that occurs under your account. If you suspect unauthorized use of your account, notify us immediately.
We implement measures to secure accounts (such as authentication tokens and encrypted communications), but you must also safeguard your account. Use a strong password and limit access to your device. We are not liable for any loss or damage arising from unauthorized access resulting from your failure to secure your credentials.
You agree not to create multiple accounts or impersonate others. If you use Sign in with Apple, ensure you only sign in with your own Apple ID. Do not provide an email that you do not own or control.
You may delete your account at any time via the app settings (which will remove your data). We reserve the right to suspend or terminate your account (or access to certain features) for any violation of these Terms or suspect misuse. Upon termination, these Terms will also terminate, but sections regarding intellectual property, disclaimers, and liability will survive. Termination can result in deletion of your data, so please back up any personal data you wish to keep.
You can use BloomEDU without creating an account (“Guest Mode”). In Guest Mode:
Guest users can create an account at any time to unlock full features and preserve their progress.
We grant you a personal, non-transferable, non-exclusive license to install and use BloomEDU on your mobile device for personal, non-commercial purposes. This means you can use the App to learn about wildflowers, take quizzes, and track your progress. You may not distribute or make the App available over a network where it could be used by multiple devices at the same time (except via official app store family sharing if applicable).
You agree not to engage in any of the following when using the App:
If you upload or create any content via the App (for example, adding an observation note or uploading a photo for identification), you retain ownership of that content. However, you grant Skylark Creations LLC a license to use, store, and process your content for the purpose of providing the service. For instance, if you upload a plant screenshot for identification, you give us permission to send it to our AI service and to extract and display the plant name result to you. We will handle user content in line with our Privacy Policy, and we won’t use your content outside the scope of providing or improving BloomEDU without additional consent. You are solely responsible for any content you provide and must ensure you have the rights to share it (e.g., don’t upload images you’re not authorized to use).
We welcome feedback and suggestions to improve BloomEDU. If you provide feedback, you agree that we can use it without any restriction or compensation to you, and you irrevocably assign to us all right, title, and interest in that feedback.
Unless otherwise indicated, Skylark Creations LLC (or our licensors) owns all rights, title, and interest in the BloomEDU app and its content. This includes the software code, design, quizzes, questions, compiled wildflower data, and the “BloomEDU” name and logos. All these are protected by intellectual property laws.
Some plant images or facts in the App are sourced from third parties and are used under license or fair use with attribution. All third-party content rights remain with their respective owners. We credit image sources where required and do not claim ownership of those images. Your use of such images through our App must respect the original licenses (e.g., some images may be Creative Commons licensed requiring non-commercial use and attribution). The App will provide attribution info for these purposes.
You are allowed to use the App and its content for personal educational purposes. You may not reuse the App’s content (questions, data, code, etc.) for any commercial purpose without our written permission. You also may not use our trademarks (like the name “BloomEDU” or our logos) without authorization.
If the App includes any open-source software libraries (e.g., those listed in our documentation or package files), those are covered by their own licenses. We respect those licenses and include necessary notices within the app or documentation.
BloomEDU offers an optional subscription (“Premium Access”) which unlocks additional features and content (for example, observation-based quizzes and any new premium features). The subscription is $2.99 (USD) per month as of the latest update. Prices may vary by region and are subject to change (if we change the price, it will only affect new subscriptions or renewals with notice to you).
You can purchase a premium subscription with or without creating an account. For guest users, the subscription is tied to your device through an anonymous identifier. For registered users, the subscription is linked to your account and accessible across all your devices.
The premium subscription is purchased through the Apple App Store’s in-app purchase system. This means your payment will be charged to your Apple ID account upon confirmation. The subscription automatically auto-renews at the end of each billing period (monthly, or annually if you choose an annual option) unless you cancel at least 24 hours before the renewal time. Apple may bill you for the renewal within 24 hours prior to the end of the current period.
You can manage or cancel your BloomEDU subscription at any time via your Apple App Store account settings. For example, you can turn off auto-renewal or cancel future renewals. If you cancel, you will continue to have premium access until the current paid period ends, after which your access to premium features will revert to the free tier.
If we offer a free trial or promo code (e.g., a scholarship code for free months), those are one-time offers and are subject to their specific terms. After a free trial ends, if you have not canceled, you may be charged for the subscription. Promotional codes (like scholarship codes) have no cash value and are not guarantees of service; we reserve the right to discontinue or modify such offers.
All charges are final and non-refundable except at our discretion or as required by law. Since the App Store handles billing, any refund requests must generally be directed through Apple. Some jurisdictions may provide cancellation rights for online purchases – if applicable, you will need to follow Apple’s refund policies. We cannot issue refunds directly for in-app purchases made through Apple.
We reserve the right to add, remove, or modify the features of the free tier or premium tier. We might, for example, introduce new features to the free version or move a feature to premium to sustain the service. We will communicate any major changes to the subscription scope. If a change significantly reduces the value of your current subscription, we will give you an opportunity to cancel before it takes effect.
If a subscription payment fails (due to an expired card or other issues with your Apple account), Apple may cancel the subscription. If you lose premium status due to non-payment, you will lose access to premium features until you re-subscribe. We won’t try to provide premium features without a valid subscription.
Your privacy is important to us. Our Privacy Policy describes what data we collect and how we use it. These Terms incorporate the Privacy Policy by reference. By agreeing to these Terms, you also consent to our data practices as outlined in the Privacy Policy. If you do not agree with our data handling, please do not use the App. Key points: The App will collect and use your data as needed to provide the service (for example, storing your progress, processing your plant observation images via an AI service, etc., as detailed in the Privacy Policy). BloomEDU provides educational content about wildflowers (including quiz questions and identification aids). While we strive for accuracy in all information, we do not guarantee that every question, answer, or plant detail is 100% accurate or up-to-date. The content is for learning and general knowledge. Do not rely on the App for any critical decision-making. For instance, do not consume wild plants based solely on identification from this App – always consult a field expert or guide. We are not responsible for how you apply the information learned from the App in real-life situations. Use common sense and caution in nature.
The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind. We explicitly disclaim any warranties or conditions of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the App will be error-free or uninterrupted. For example, we do not guarantee that the App or any content will always be available, that uploads (like your screenshots) will always successfully yield a result, or that the results (like plant identifications or quiz outcomes) will meet your expectations.
You acknowledge that BloomEDU involves technology (like AI image recognition and spaced repetition algorithms) that may occasionally produce incorrect or unexpected results. There may be times when our AI cannot identify a plant from your image, or might mislabel it – always double-check identifications. Likewise, while our server and database are robust, no software is perfect and there is a small possibility of data loss or bugs. We will work to fix any issues, but we cannot promise that the App will be free of defects.
Using BloomEDU does not guarantee you will become a wildflower expert or achieve any particular level of knowledge. Your learning progress depends on many factors, and the App is just a tool to assist you. We make no promise that you will pass any real-world test or certification by using our quizzes.
The App relies on third-party services (OpenAI, Apple, RevenueCat, image hosts, etc.) to function. We are not responsible for acts or omissions of these third parties. For example, if the OpenAI API is down or returns an error, the plant identification feature may not work temporarily. If Apple’s App Store or RevenueCat service has outages, subscription verification might be delayed. You agree that these are outside our control and not our responsibility, though we will make reasonable efforts to keep the App functional.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not fully apply to you. In such cases, our warranties are limited to the minimum extent permitted by law.
To the fullest extent allowed by law, Skylark Creations LLC (and its owners, developers, and affiliates) will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, goodwill, or other intangible losses, resulting from:
In no event shall our total liability exceed the amount you have paid to us for the service in the last 12 months (and if you have paid nothing, then $0). For example, if you have a yearly subscription and something goes wrong, our maximum liability would be up to the subscription cost you paid for that year, and no more. We are not liable for any issues beyond our control, such as failures in mobile networks, device incompatibility, or events of force majeure (natural disasters, acts of government, etc.). Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of these limitations may not apply to you. In those regions, our liability is limited to the greatest extent permitted by law.
You agree to indemnify and hold harmless Skylark Creations LLC and its affiliates, officers, agents, and employees from any claim or demand (including reasonable attorneys’ fees) made by any third party due to or arising out of:
For example, if you use the App in a way that causes us to be sued or fined (such as using it for illegal activity or scraping content and republishing it unlawfully), you will cover those costs.
We are constantly improving BloomEDU and adding or removing features. The form and nature of the App may change over time without prior notice. We may release updates, and you may need to update your app to continue using certain features. We reserve the right to discontinue (temporarily or permanently) the App or any part of it with or without notice. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuation of the service.
We may update these Terms from time to time. If we make material changes, we will notify you by posting the revised Terms in the app or through other communications. The “Last updated” date will reflect the new revisions. It’s your responsibility to review any updated Terms. By continuing to use BloomEDU after changes become effective, you agree to the revised Terms. If you do not agree, you must stop using the App and, if applicable, cancel any subscriptions.
These Terms are governed by and construed in accordance with the laws of the State of Colorado, USA, and applicable United States federal law. This choice of law does not deprive you of any consumer protections under the law of your residence.
You agree that any dispute or claim arising out of or in connection with these Terms or your use of the App will be subject to the exclusive jurisdiction of the state and federal courts located in Colorado, unless otherwise required by applicable consumer law (for example, certain EU users might have the right to bring claims in their home country).
We prefer to resolve issues amicably. Before filing any claim against us, you agree to try to resolve the dispute informally by contacting us at hello@skylarkcreations.com. We will attempt to address your concerns through dialogue. If a dispute cannot be resolved informally, then, subject to the above jurisdiction clause, you or we may initiate formal legal proceedings.
These Terms (along with the Privacy Policy) constitute the entire agreement between you and Skylark Creations LLC regarding BloomEDU, superseding any prior agreements (whether oral or written) about the App.
If we fail to enforce any right or provision of these Terms, it does not mean we waive that right. A waiver is only effective if in writing and signed by our authorized representative.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full effect. The invalid provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law, reflecting the parties’ intent as closely as possible.
You may not assign or transfer your rights or obligations under these Terms to anyone else without our prior written consent. We may assign our rights and obligations to an affiliate or in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.
These Terms do not confer any third-party beneficiary rights. No other person or entity shall have any rights to enforce any term of this agreement.
You acknowledge that these Terms are between you and Skylark Creations LLC, not with Apple. However, your use of the App must also comply with Apple’s App Store terms of service. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, shall have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof (this is a requirement of Apple’s terms).
